By enrolling or signing up online on our website, you agree to Drive Well Driving School’s Privacy Policy and Terms of Service. Submitting your information or booking lessons means you have read, understood, and accepted these terms. For students under 18, registration must be completed by a parent or legal guardian, and the consents in these terms are granted by that parent or guardian.

Enrollment Agreement Policy

  • Student Contracts: All students (or their parent/guardian if under 18) are required to sign an enrollment agreement before beginning lessons. Families are responsible for keeping their own signed copy. Drive Well Driving School will retain a copy for internal records only.
  • Requesting a Copy: If a family requires a copy of the signed agreement with a school representative’s signature, this request must be made before the completion of the package. Requests made after the package has ended cannot be guaranteed.
  • Multiple Packages: Each new package requires a new signed enrollment agreement. Families must provide the signed agreement within 15 business days of starting a new package. If not provided, lessons may be suspended until documentation is complete.
  • Dispute Resolution: Students and parents must contact school management directly in writing regarding any concerns before posting online. Verified claims will be resolved promptly and fairly. Posting false or defamatory claims on public platforms may result in legal action.
  • Commitment to Safety: Drive Well Driving School has maintained a strict zero-tolerance policy for unprofessional conduct for over 10 years. All instructors undergo DMV certification and background checks. Many vehicles are equipped with cameras for accountability. All complaints are investigated thoroughly, and corrective action is taken if supported by evidence.

Student Conduct & Instructor Interaction Policy

  • Instructors and students must maintain professional conduct at all times. Personal discussions, gift exchanges, or food purchases during lessons are strictly prohibited.
  • Lessons take place only in approved training vehicles and designated driving areas. Off-site or unscheduled meetings between instructors and students are not permitted.
  • Students and parents agree to immediately report any concerns about conduct, communication, or behavior to management in writing for prompt investigation.
  • False or malicious claims intended to harm staff reputation or business credibility may result in legal action.

Vehicle Camera & Recording Policy

For safety, training quality, and accountability, some Drive Well Driving School vehicles are equipped with dash cameras or in-car recording systems.

  • Recording is limited to lesson sessions only and may include video and audio as permitted by Virginia law.
  • Footage is used strictly for safety review, quality control, and in the event of a complaint or incident investigation.
  • Recordings are stored securely and automatically deleted after a standard retention period unless required for investigation or legal compliance.
  • By enrolling in our services, students and parents consent to being recorded during official driving sessions.
Note: Safety and training footage is never published for marketing purposes. Promotional use of any photo, video, or audio is governed separately by the Photo, Video & Audio Media Release below.

Student Eligibility & Document Accuracy

  • Students must hold a valid Virginia learner’s permit or driver’s license and have it physically present at every lesson.
  • Students and parents are responsible for providing accurate information regarding permit status, age, driving experience, and Driver’s Education completion at registration.
  • Providing false or inaccurate information voids Drive Well Driving School’s responsibility for resulting delays, cancellations, or program ineligibility, and no refund is owed for sessions canceled as a result.

Medical Fitness Disclosure

  • Students (or their parent/guardian) must disclose, before lessons begin, any medical condition that could affect safe vehicle operation, including but not limited to seizure disorders, vision impairment, hearing impairment, or medications that cause drowsiness or impaired judgment.
  • Drive Well Driving School may request reasonable accommodations be discussed in advance so lessons can be conducted safely.
  • Failure to disclose a known medical condition shifts responsibility for any resulting incident to the student or their parent/guardian.

Impairment Policy

  • Instructors may end any lesson immediately if a student appears to be impaired by alcohol, drugs, prescription medication, or severe fatigue.
  • A lesson ended for suspected impairment is forfeited, and the standard rescheduling fee applies.
  • This policy exists to protect the student, the instructor, and the public.

Information We Collect

We may collect the following information when you register or use our services:

How We Use Your Information

Children’s Privacy

Our services are intended for students 15 years and 6 months of age or older. Information about minors is collected only from, or with the consent of, a parent or legal guardian. We do not knowingly collect information directly from individuals younger than 15 years and 6 months.

Lesson, Cancellation & Refund Policies

  • Notice Requirement: Canceling or rescheduling with less than 24 hours’ notice will result in a $40 fee.
  • No-Shows: If a student fails to attend a session, arrives without a valid permit/license, or is unprepared to drive, the session will be canceled. A $40 rescheduling fee will apply.
  • Refunds During Packages: Completed lessons will be charged at $70 per hour. Any remaining balance will be refunded within 14 business days.
  • Online Courses: All online courses are non-refundable.
  • Package Switching: Switching to a different package requires full payment of the difference before the current package ends.

Weather & School-Initiated Cancellations

  • Drive Well Driving School may cancel or reschedule a lesson due to unsafe weather conditions, road conditions, vehicle maintenance needs, or instructor unavailability.
  • No fee is charged to the student for a school-initiated cancellation, and the lesson will be rescheduled at no additional cost.
  • School-initiated cancellations do not entitle the student to a refund of the package; the affected lesson is rescheduled instead.

No Guarantee of Outcomes

Completion of any Drive Well Driving School program does not guarantee the issuance of a driver’s license, passage of any DMV test, or any specific result. License issuance is governed solely by the Virginia Department of Motor Vehicles and applicable Virginia law. Drive Well Driving School’s responsibility is limited to providing quality instruction and accurately submitting required paperwork upon successful program completion.

Student-Caused Damage

  • Students, or their parent/guardian for students under 18, are financially responsible for damage to school vehicles or property caused by intentional misconduct, reckless behavior, or refusal to follow instructor direction.
  • Normal wear and tear from ordinary training is never charged to the student.

Payments & Fees

  • All fees must be paid before scheduling additional sessions.
  • Rescheduling, cancellation, or no-show fees are non-refundable.
  • Drive Well Driving School reserves the right to suspend or cancel lessons if payments are not made.

Chargeback Policy

  • Any billing dispute must first be submitted to school management in writing so it can be reviewed and resolved directly.
  • Initiating a payment chargeback without first contacting the school constitutes a violation of these terms.
  • Drive Well Driving School reserves the right to suspend services and to recover costs, including fees incurred, associated with chargebacks found to be invalid.

Complaint Resolution Process

All student or parent concerns must first be submitted directly to Drive Well Driving School management via email or our contact form. Complaints will be acknowledged within 48 business hours and investigated promptly.

  • During an investigation, related lessons may be paused for safety.
  • Findings will be reviewed based on available evidence such as communication records, dashcam footage, and instructor logs.
  • If a concern is verified, corrective action will be taken immediately. If unsubstantiated, documentation will be retained for record-keeping.
  • Posting unverified or defamatory claims online before investigation completion may be considered a violation of this policy.

Communication Policy

Drive Well Driving School values clear and professional communication with both students and parents. To maintain transparency and protect all parties, the following guidelines apply:

  • Communication about scheduling, lessons, or updates will normally be directed to the student who registered for the program.
  • If the student is under 18, parents or guardians are strongly encouraged to remain in the communication loop. Parents may request, in writing or by email, to be copied on all scheduling and progress updates.
  • Instructors are not permitted to engage in personal or non-lesson-related communication with any student. All communication must remain professional and limited to scheduling or training topics.
  • When possible, group messages including both the parent/guardian and student are encouraged to ensure everyone stays informed.
  • Students are responsible for keeping their parents or guardians updated about schedules, lesson changes, or school communications unless other arrangements are confirmed in writing.
  • Instructors may communicate directly with parents or students to confirm lesson details or pick-up/drop-off logistics, provided the communication remains professional and transparent.

Feedback & Misuse

We value constructive feedback. However, false, defamatory, or malicious claims intended to harm our reputation may result in legal action.

Governing Law & Venue

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or our services shall be resolved exclusively in the state courts located in Loudoun County, Virginia.

Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Updates to Policy

This Privacy Policy and Terms of Service may be updated periodically. Updates will be posted on our website and take effect immediately.

Legal Disclaimer & Assumption of Risk

Driving instruction involves inherent risks. By enrolling in Drive Well Driving School, students and guardians acknowledge the inherent risks associated with driving instruction and voluntarily assume those risks. The school and its instructors are not liable for accidents, injuries, or damages that may occur during lessons, training sessions, or while operating any vehicle. Students are expected to follow all instructor guidance, Virginia DMV laws, and safety rules at all times.

Notice of Defamation Policy: Publishing false statements about Drive Well Driving School or its staff may constitute defamation under Virginia law (Code § 8.01-45). The school reserves the right to pursue legal remedies for knowingly false or malicious claims.
